The offer and sale of products on our website (www.lovehorses.it) is governed by these General Terms and Conditions of Sale.

1. Our General Terms and Conditions of Sale
1.1 These General Terms and Conditions of Sale apply solely to the offer, submission and acceptance of purchase orders relating to products on the website.
2. Purchasing Products
2.1 To conclude a contract to purchase one or more products from www.lovehorses.it, you must fill in the online order form and send it electronically to LOVEHORSES, following the instructions provided.
2.2 In Section 7 is a summary of the terms and conditions for exercising your right to cancel your order and a summary of the terms and conditions for returning purchased products using the returns/exchange form at the following link: link pagina web.
On the order form, which appears just before the completion of the sales contract, LOVEHORSES provides you with a summary of the main characteristics of each product ordered, and the price, including taxes and the cost of shipping.
The contract is concluded once LOVEHORSES has received your order form electronically and checked that the order information is correct.
2.3 The order form will be stored in our database for the time required to process and ship your order and in accordance with the law. You may access your order form from your account.
2.4 When you proceed with the submission of your order form, you will be notified that placing the order implies an obligation to pay the stated price. Before submitting your order form, please check and correct any errors you may have made when entering your details.
2.5 The contract with LOVEHORSES may be concluded in Italian or English.
2.6 Once the sale has been completed, LOVEHORSES will process your order.
2.7 LOVEHORSES cannot process orders that are incomplete or incorrect, or if the products are no longer available. In this event, we will notify you by email that the order has not been processed with an explanation. If products displayed on are no longer available or for sale when you submit your order form, LOVEHORSES will notify you about the unavailability of the ordered products as soon as possible and not later than ten (10) days from the day after you placed the order. If you have already ordered and paid for products that are unavailable, LOVEHORSES will refund the amount paid, without undue delay, and the contract between the parties shall be deemed terminated.
2.8 By submitting an order form, you unconditionally accept and undertake to comply with these General Terms and Conditions of Sale in your contract with LOVEHORSES. If you do not agree with any of the General Terms and Conditions of Sale, please do not submit an order form to purchase products from .
2.10 Once the sale has been concluded, LOVEHORSES will send you an email confirming that your order has been received.
2.11 Please note that any products purchased shall be delivered exclusively in the country in which the order was placed; therefore, if you decide to introduce the product to another country, you are responsible for that and bound to comply with the laws and restrictions concerning exports from the country in which you purchased the product and imports into the country where you intend to introduce it. LOVEHORSES hereby states that it does not accept any liability for the aforementioned.
3. Products Prices: Pricing and Guarantees
3.1 The main characteristics of the products are shown on each product page on www.lovehorses.it. However, the images and colours of the products sold on the website may not correspond to the actual colours due to your web browser or monitor.
3.2 Product prices may be subject to change. Please check the final price before submitting your order form.
3.3 Should you decide to exercise your right to cancel your order, LOVEHORSES can decide not to accept a return or provide a refund for products if their main characteristics or quality have been altered or if they have been damaged in accordance with the right of cancellation terms set forth in Section 7.5.
4.1 LOVEHORSES uses the payment information that you provide for the sole purpose of processing your order and issuing a refund in the event that you exercise your right of cancellation and return a product.

5.1 To learn more about how we ship and deliver products, please read the section about "Delivery Times and Methods" towards the end of these General Terms and Conditions of Sale.

7. RIGHT TO CANCEL
As a LOVEHORSES customer, you have the right to cancel an order under Legislative Decree No. 206/2005.
7.1 You have the right to cancel the contract concluded with LOVEHORSES without incurring any penalty and by providing a reason within fourteen (14 ) days from the day on which you receive the products purchased on www.lovehorses.it. Only in some specific cases will it be possible to exchange the purchased item for another.
7.2 If you wish to cancel the contract, please use the returns form at LINK PAGINA (which complies with the sample form under Section 49 (paragraph 4) of the Italian Consumer Code). The form should be filled in and sent online on the website. LOVEHORSES will email you confirmation when we have received your request to cancel the order.
If you choose to use another method to notify LOVEHORSES that you wish to cancel the contract, you are responsible for proving that you exercised your right of cancellation correctly and within the specified time period.
7.3 Once you have exercised your right of cancellation, you must return the products to LOVEHORSES by post or by a courier service of your choice to the following address: LOVEHORSES di Chemoli Barbara – 6 Via Montindon – 37026 PESCANTINA (VR) - Italy, within fourteen (14) days of notifying LOVEHORSES of your decision to cancel the contract.
7.4 Products are returned at your own expense and you are liable for any products lost or damaged during transport, irrespective of whether this is due to a negligent choice of courier service and/or shipping method.
7.5 In addition to complying with the terms and methods set forth in the applicable paragraphs, your right to cancellation is correctly exercised if the following conditions have been fully met:
1. The returns form which is available at LINK della pagina was correctly filled in and sent to LOVEHORSES within fourteen (14) days of receipt of the products;
2. The products must not have been used, worn or washed;
3. The products must be returned in their original packaging;
4. The returned products must be shipped within fourteen (14) days of when you notified LOVEHORSES of your decision to cancel the contract;
5. The products must not be damaged.
We are only able to offer returns on personalised items if the items are faulty.
7.6 If you exercise your right of cancellation in compliance with the terms and conditions stated herein, LOVEHORSES will refund any payments that it has already received for the purchase of the products in accordance with the applicable terms and conditions.
7.7 Your refund will be processed as soon as possible and, in any event, not later than fourteen (14) days from when LOVEHORSES received notification of you exercising your right of cancellation.
Once LOVEHORSES has ascertained the correct performance of the terms and conditions set forth above and in Section 8, it will begin the refund procedure.
7.8 Should you fail to comply with the applicable terms and conditions when exercising your right of cancellation, you shall not be entitled to a refund of payment already made to LOVEHORSES. Once LOVEHORSES has emailed you with its decision not to accept the return, you have fourteen days (14) within which to decide whether to have the products returned to you, at your own expense, in the condition in which they were returned to LOVEHORSES, according to conditions of which you will be notified. If you choose not to do this, LOVEHORSES may keep the products as well as the payment made for their purchase.

8.1 Once the products have been returned, LOVEHORSES will check that all the terms and conditions set forth in Section 7.5 have been met.
If your return complies with these terms and conditions, LOVEHORSES will email you to confirm that the returned product has been accepted. However, if your return does not comply with these terms and conditions, LOVEHORSES will notify you by email you about the problem caused by failure to comply with the terms and conditions set forth in Section 7.5.
You may have the products returned to you, at your own expense, in the condition in which they were returned to LOVEHORSES, in accordance with the terms set forth in the previous section.
8.2 Irrespective of your payment method, LOVEHORSES will process your full or partial refund as soon as possible and, in any event, not later than fourteen (14) days from when LOVEHORSES received notification of you exercising your right of cancellation, ascertained that said right was correctly exercised, and checked the condition of the returned products.
8.3 Should you decide to exercise your right of cancellation and the recipient of the products named on the order form and the individual that paid for their purchase are not the same person, LOVEHORSES will refund the party that made the payment.
9. Legal Guarantee of Conformity
If a product is faulty, you are entitled to choose a repair or replacement for the faulty goods from LOVEHORSES, free of charge, unless this is not possible or excessively expensive in comparison. Where the replacement or repair are not possible, you are entitled to a discount or a refund, commensurate with the value of the goods, once you have returned the faulty product to LOVEHORSES.
To be valid the warranty claim must be made not later than seven (7) days from discovery of the fault: this is why you must always keep your receipt as proof of purchase.

10. Exchanging Products
Instead of exercising your right of cancellation in some specific cases, which are duly stated on the returns/exchange form, you may exchange the products you purchased rather than receive a refund.
Items may only be exchanged under the following conditions:
a) product exchange shall only apply to purchased products when this option is expressly specified in the applicable field on the returns/exchange form;
b) you may request the exchange of one or more purchased products only for products of the same model, but in a different colour and/or size. In any event, requests must be specified in the applicable field on the returns/exchange form;
c) you may request the exchange of one or more purchased products not later than fourteen (14) working days from the date of delivery by filling in the online returns/exchange form which must be sent to LOVEHORSES within this time period.
d) you may only submit one exchange request for each product that you purchased;
e) when requesting an exchange, these products must be returned to LOVEHORSES in their original packaging and must not have been used, worn, washed or damaged.
f) the products you wish to exchange must be sent to LOVEHORSES – 6 Via Montindon – 37026 PESCANTINA (VR) – ITALY.
If all the aforementioned terms and conditions are correctly met and the applicable form for requesting an exchange has been filled in and sent, LOVEHORSES will process your request and send you a confirmation email.
We are only able to exchange or replace personalised products if the items are faulty.
11. Replacing Products
Once LOVEHORSES has received the products that you wish to exchange and checked that all requirements have been met, it will ascertain whether the products are available in your chosen size and/or colour.
If the product or products that you wish to receive in exchange are not available, LOVEHORSES cannot process your exchange request and will therefore refund the price of the originally purchased but non-exchangeable product or products in accordance with the terms set forth in Section 8.2 of these General Terms and Conditions of Sale.
If the product or products that you wish to receive in exchange are available, LOVEHORSES will process your exchange request and send you a confirmation email once the replacement products have been dispatched. The goods will be dispatched not later than thirty (30) days from when LOVEHORSES has received the exchange request and checked that all the terms and conditions set forth in Section 7.5 have been met. LOVEHORSES will pay the shipping costs for the replacement products and choose an appropriate courier service.
If the price of the originally purchased product is more or less than the price of the product that you wish to receive in exchange, there will no refund or added charge for the difference.
You will be contacted if we cannot accept your exchange request because it does not comply with the terms and conditions set forth in Section 7.5. If this happens, you may choose to have the products that you wished to exchange returned at your own expense. Should you refuse this delivery, LOVEHORSES reserves the right to keep the products.
12. THE CONSUMER CODE
The terms and conditions for exercising your right of cancellation are an integral part of these General Terms and Conditions of Sale, and governed by Italian law, specifically by Chapter I “Consumer Rights in Contracts” of the Consumer Code, Legislative Decree No. 206 of 6 September 2005.
13. PAYMENT TERMS AND CONDITIONS
You may use the methods stated on the order form and summarised below to pay for the products and the applicable shipping and delivery costs:
- Postepay ;
- Cash on delivery (for Italy and non-personalised items only);
- Advance bank transfer: products purchased with this method may only be dispatched once payment has been received.
14. DELIVERY TIMES AND METHODS
14.1 (ready-to-ship items – NOT personalised items)
At LOVEHORSES, we pass your orders to our courier service within two days of receipt of payment. The delivery times apply to when the courier has collected the order.
Northern and Central Italy: within 2 working days.
Southern Italy and islands: within 4 working days.
EU countries: within 3 to 6 working days.
Cyprus, Estonia, Latvia, Lithuania, and Malta: within 5 to 9 working days.
All other countries: within 15 working days (delivery times may vary depending on how long Customs take to clear your goods).
Deliveries may be subject to delays during busy times, such as the holiday periods in August and December.
LOVEHORSES is not liable for any delays or misdelivered orders attributable to the courier service.
Please note that couriers do not deliver on Saturdays or Sundays.
At LOVEHORSES, we do our best to dispatch orders no later than thirty (30) working days after the customer has paid for an order.
14.2 (personalised items)
With LOVEHORSES you can personalise the items you order to match your dress code and personal style.
Personalising items takes time because LOVEHORSES products need to be assembled, made and checked one by one to guarantee their high quality.
Most orders are dispatched within 4 to 6 weeks. You can check the progress of your order at any time by contacting our Customer Service via the “Contact” page.
LOVEHORSES always notifies customers as soon as possible if there is a problem that may delay the order, such as perfecting the graphics for the embroidery or if the product has any special requirements. By working together we can always find the best solution.
LOVEHORSES dispatches orders to customers using our preferred courier services at the stated rates; we aim to deliver orders in 5 to 6 working days in Italy and in 10 to 11 working days in EU countries. Delivery times for all other countries may vary depending on how long Customs take to clear your goods.
At LOVEHORSES, we do our best to dispatch orders no later than thirty (30) working days after the customer has paid for an order.
LOVEHORSES provides various delivery options and we can only dispatch an order once we have received payment from the customer for the selected option.
LOVEHORSES di Barbara Chemoli issues tax documentation based on the details provided by the customer when the order is submitted.
15. DELIVERY AND PASSING OF RISK
Ownership of the goods passes to you, the customer, upon delivery to the carrier. The goods travel at the risk and peril of the customer even if sold free of carriage and it is agreed that each shipment is sent on behalf of the customer so LOVEHORSES is exempt from any liability upon delivery to the carrier. In the event of non-payment, LOVEHORSES has the right to take all legal measures, including enforcement or rather repossession under Article 1519 of the Civil Code.
Furthermore, it is understood that LOVEHORSES has the right to request full compensation for any damage incurred due to non-performance by the customer.
16. PRODUCT AVAILABILITY
LOVEHORSES does its best to ensure that all the non-personalised items displayed on the website are in stock, and available for dispatch within fourteen (14) working days. Should an order exceed the stock in the warehouse, we will let you know how long it will take to process the entire order. You can decide whether you prefer to wait or authorise us to dispatch the number of available products.
